Tacloban City (10 October) -- Per Proclamation No. 1397, October 12, 2007 has been declared as a regular holiday throughout the country in observance of Eid'l Fitr or Feast of Ramadhan.
Along this line, the Department of Labor and Employment (DOLE), Region 8 through its Regional Director Forter C. Puguon reminds all employers on the observance of the rules and regulations for regular holiday which will be observed during non-working holiday.
Some of these rules state that an employee will receive his or her regular wage even if said employee does not work on October 12, whether the day is the employee's regular workday or rest day.
On the other hand, if the day is a regular working day for the employee and the employee works on that day, said employee gets 200% of the regular wage for that day. Further, if said employee works in excess of eight hours, said worker receives the hourly wage for that day, which is 200% of his or her regular wage divided by eight, plus 30% of that hourly rate.
Lastly, if the day is the employee's rest day and the employee works on that day, said employee receives 260% of the employee's regular wage. If the employee renders overtime services, said employee receives his or her hourly rate for that day which is 260% of the employee's regular wage divided by eight, plus 30% of that rate.
Relative to this, Director Puguon warns that DOLE is currently monitoring on the compliance of said rule by the different employers considering that many establishments in the region were found to have violated the law on regular holiday pay during the conduct of Inspection Blitz.
