Pay rules for August 18 and 25 holidays out

Iloilo City (14 August) -- The Department of Labor and Employment (DOLE) has issued pay rules for August 18 and 25 which have been declared special non-working day and regular holiday throughout the country.

Labor and Employment Secretary Marianito D. Roque, in a press report, said that Presidential Proclamation No. 1463 provided for the commemoration of the Ninoy Aquino on the Monday nearest to August 21 in line with Republic Act No. 9492.

Proclamation No. 1463 was signed by President Gloria Macapagal Arroyo on February 10, 2008.

The same Presidential Proclamation, said Roque moved the holiday commemorating the country's National Heroes Day for the year 2008 on August 25, the last Monday of August, instead of last Sunday of August.

In line with this, Roque reiterated to all employers in the private sectors the pay rules applying on the special non-working day on August 18, and on the regular holiday on August 25.

For the special non-working day on Monday, August 18, if the day is unworked, the no-work, no-pay policy shall apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day even if the day is unworked.

On the other hand, if the day is worked, the pay is the employee's daily rate plus thirty percent (30%) for the first eight hours of work, and for work in excess of eight hours, plus thirty percent (30%) of the hourly rate on said day.

Finally, if the day falls on the employee's rest day and is worked, the employee's daily rate plus fifty percent (50%) shall apply on the first eight hours of work, and for work in excess of eight hours, plus thirty percent (30%) of the hourly rate on said day.

Meanwhile, for the regular holiday on August 25, the last Monday of August, workers should be paid 100 percent of their regular salary for that day if it is the workers' regular workday and the day is unworked.

If worked, 200 percent of the regular daily rate shall apply on the first eight (8) hours, and in excess of eight hours, plus 30% of the hourly rate for that day.

If the day falls on an employee's rest day and is unworked, 100 percent of the regular daily rate shall apply. If worked, 230% of the regular daily rate shall apply, and in excess of eight hours, plus 30% of the hourly rate on the said day. (PIA) [top]
