Congress urges DILG to complete land use plan
Manila (30 November) -- The House of Representatives is strongly urging the Department of Interior and Local Government (DILG) and the Housing and Urban Development Coordinating Council to direct all local government units and local development councils to immediately complete or update their respective comprehensive land use plan.
"The LGUs are in the most strategic position to determine how to maximize the development of their land resources without jeopardizing the environment," Rep. Rodolfo Valencia, chairman of the House Committee on Housing and Urban Development said.
Chairman Valencia revealed that his committee successfully steered the plenary approval and adoption of House resolution No. 43 last November 9 in support of the faithful implementation of the Local Government Code of 1991.
"This measure is one of those adopted or passed by the House since the SONA as revealed by Speaker Feliciano Belmonte, Jr., who stressed that the House of Representatives is determined to pursue a legislative agenda that focuses on national productivity and poverty alleviation," Valencia said.
The measure notes that R.A. 7160 or the Local Government Code mandates LGUs, in conformity with existing laws, to continuously prepare their respective comprehensive Land Use Plan (CLUP) enacted through zoning ordinances to serve as the primary and dominant bases for the future use of land resources.
Likewise, the formulation, adoption or modification of the said plan by the component cities and/or municipalities shall be in coordination with the approved Provincial Comprehensive Land Use Plan (PCLUP).
Furthermore, Valencia said, R.A. 7279 or the Urban Development and Housing Act of 1992 gives a clear-cut definition of a land use plan which LGUs are mandated to adopt.
The LGUs should have an updated plan that would "identify lands for socialized housing needs of the underprivileged and the homeless in the urban areas and that government-owned lands which have not been used for their reserved purpose ten (10) years from the effectivity of R.A. 7279 and identified as suitable for socialized housing shall immediately be transferred to the National Housing Authority, subject to the approval of the President or the concerned LGU, for its proper disposition."
Valencia noted that the previous governments - Presidents Fidel Ramos, Josephy Ejercito Estrada and Gloria Macapagal-Arroyo - have regarded the matter of land use with utmost importance resulting to the issuance of Executive Orders in 1993, 2000 and 2009, respectively.
Further, Valencia also noted that "between Feb. 1997 and Feb. 20023, the DILG had issued eight (8) memorandum circulars enjoining the LGUs to complete and update their respective CLUPS, even imposing as sanction the withdrawal of authority to issue developmental permits of the LGUs without an updated CLUP or the filing of administrative charges thereof against those found to be negligent of their duties."
