Davao's Duterte limits operation of video-karaoke bars

Davao City (6 December) -- City Mayor Rodrigo R. Duterte signed Executive Order 18, limiting the operation of video-karaoke and sing-along in bars, restaurants, eateries and similar establishments without sufficient enclosures and causing excessive noise up to only to 10:00pm.

City Administrator Wendel Avisado said there is a continuing proliferation of bars, restaurants, eateries and similar establishments offering liquor and videoke to the public in Davao City without the necessary enclosures to muffle the loud sound or noise continuing until the wee hours of the morning.

These caused residents near said establishments to lose sleep and a great deal of disturbance on the neighborhood.

"There exist a strong clamor from the public to immediately address this current problem and the Mayor has also ordered law enforcement officers to implement EO 18", Avisado said.

The General Welfare Clause, otherwise known as the Local Government Code authorizes every local government unit to enact such measures that will enhance the public health, safety, convenience, maintain peace and order, and promote the general prosperity of its inhabitants.

The same Code empowers the City Mayor to issue such executive orders including its enforcement.

The Code of Sanitation of the Philippines considers excessive noise as a nuisance which must be abated.

Davao City Ordinance 404 also regulates the establishment, maintenance and operation of bars within the city of Davao. (PIA-XI) [top]
