DPWH 8 reiterates MOA prohibiting obstructions on road right-of-way

Tacloban City (July 6) -- Department of Public Works and Highways (DPWH) Regional Office 8 Director Jaime Pacanan reiterated the Joint Memorandum of Agreement entered into by and between the DPWH and the heads of national agencies and local government units supporting the implementation of Operation Arrow on April 15, 2003.

Director Pacanan informed that this was executed in amplification of Department Order Nos. 52 series of 2003 and No. 04 series of 1987, otherwise called as the "Removal of Obstructions and Prohibited Uses within the Right-of-Way" and the "Strict Implementation and Enforcement of the Provision of Section 30, RA 917, as amended by Section 23, Presidential Decree 17, Prohibiting Encroachments / Usurpations of any Portion of Right-Of-Way," respectively.

Director Pacanan revealed that the increasing rampant usurpations of and illegal structures encroaching within twenty (20) meters Road-Right-Of-Way limit, both sides, along national roads necessitates the strict enforcement and faithful adherence to all existing laws, rules and regulations, and policies to minimize, if not prevent, usurpations of and illegal structures encroaching within the RROW limit.

In view of this, Director Pacanan deemed it timely to remind the cooperating agencies about the MOA. The agencies include the Department of Interior and Local Government, the Department of Education, the Land Transportation Office, the Land Transportation Franchising Regulatory Board, The Department of Environment and Natural Resources, the Philippine National Police, the Armed Forces of the Philippines, the Department of Justice, the Philippine Information Agency, the Local Governments of Samar, Eastern Leyte, Biliran, Northern Samar, Leyte and Southern Leyte.

Each and every cooperating agency has specific functions to perform in connection of the program Operation Arrow, Director Pacanan reminded. He is hoping that the various signatories will be reminded of and perform their respective functions for the strict compliance and adherence to all existing laws to minimize if not completely prevent usurpations of and illegal structures encroaching within the Road-Right-Of-Way limit.
