RO1 employers required to give 13th month pay

Ilocos Norte (November 17)- It is the holiday season once again and workers are eager to receive their 13th month pay for additional holiday expenditures.

Like all employers nationwide, employers in Region 1 should provide 13th month pay for every employee as mandated in Presidential Decree 851, or the 13th Month Pay Law. And to make sure that they are complying with the law, employers are required to submit a compliance report.

Labor chief Rosalinda Dimapilis-Baldoz had issued Department Advisory No. 3 to remind employers of their obligation to submit their report of compliance with PD 851.

According to DOLE 1 director Henry John S. Jalbuena, the compliance report, which should be submitted to the DOLE not later than January 15 of each year, is included in Section 8 of the Implementing Rules & Regulations of PD 851.

Jalbuena said the compliance report should contain the name and address of the establishment; principal product or business; total employment; total number of workers who benefited; the amount granted per employee; total amount of benefits granted; and the name, position and telephone number of person giving the information.

“This reportorial requirement is a means to determine whether or not employers are complying with the 13th month pay law,” Jalbuena explained, adding that the DOLE is steadfast in pursuing its mandate under President Benigno S. Aquino III’s 22-point labor policy agenda of promoting the constitutionally protected rights of workers.

PD 851 mandates employers to release the 13th month pay of their employees not later than December 24 of every year.
